New Child Restraint law takes effect in Minnesota on July 1, 2009.  The new law states:

Children who are both under age 8 and under 4' 9" tall, while being transported in a motor vehicle, must now be in a child passenger restraint system that meets federal motor vehicle safety standards (includes booster seats).  Adult restraint belts only for these children are not allowed.  
Effective June 9, 2009: Seat belts must be worn by drivers and all passengers (not required to be in a child passenger restraint system) in any motor vehicle in Minnesota.  A properly adjusted and fastened seat belt, including both the shoulder and lap belt shall be worn. You can now be pulled over and fined for violation of this law.

  • Question:  My child is 5 years old but is 4' 10".  Does he need to be in a booster seat?  Answer:  No, this chid can use a seat belt only. 
  • Question:  My child is 9 but is only 4' 8" does she need to be in a booster seat?  Answer:  No.  Once a child turns 8 or grows to 4' 9" they can use a seat belt only.
  • Question: My child is 7 and is 4' 7" does he need to be in a booster seat?  Answer: Yes. Until he turns 8 or grows to 4' 9" he will need to be in an approved child passenger restraint system.
